Florida bill could establish ‘fetal personhood’


The Florida Senate is on the way to passing a bill that critics say would establish “fetal personhood” in civil liability cases.

But Democrats and critics of the bill argued it’s a roundabout way of creating fetal personhood, a belief that a fetus should be recognized as a legal and moral person with rights, often including the right to life, from the moment of conception.

Listen to the oral arguments at the Florida Supreme Court over Amendment 4 on abortion rights


On Feb. 7, the Florida Supreme Court heard oral arguments about a proposed constitutional amendment regarding abortion rights. If the State Supreme Court allows the issue on the ballot it will be Amendment 4.

Arguing against the amendment going on November’s ballot were Florida’s Senior Deputy Solicitor General Nathan A. Forrester and Matt Staver.

Arguing for Amendment 4 going on the 2024 ballot was Courtney Brewer, the attorney for the group supporting the abortion rights ballot initiative, Floridians Protecting Freedom.

The Supreme Court Justices weighed in with questions: Chief Justice Carlos G. Muñiz and Justices Charles T. Canady, Jorge Labarga, John D. Couriel, Jamie R. Grosshans, Renatha Francis and Meredith L. Sasso.

Supreme Court to hear abortion pill arguments in March


The Supreme Court will hear arguments on March 26 in a case that could limit the availability of the common abortion pill mifepristone. 

The justices will hear an appeal from the Biden administration and the maker of the branded version of mifepristone asking the high court to reverse a ruling from a federal appeals court that significantly curtailed access to the pill, even in states where abortion remains fully legal.

Supreme Court’s looming mifepristone decision leaves abortion rights in spotlight


The Supreme Court’s expected decision this summer on whether to restrict access to medication abortion promises to keep the issue front and center of the 2024 election.

Justices will hear a case weighing federal approval of the common abortion pill mifepristone, with a likely ruling in June — five months before voters decide who will go to the White House and Congress, and almost exactly two years after the high court overturned the constitutional right to an abortion.

Florida abortion initiative has enough signatures to appear on 2024 ballot, sponsors say


Floridians Protecting Freedom, the group behind a citizen initiative to put abortion rights on the ballot in 2024, believes it will surpass the required signature threshold this month.

The proposed amendment, titled Amendment to Limit Government Interference with Abortion, would enshrine abortion access in the Florida Constitution if passed.

Florida Abortion Measure Nears 700,000 Signatures


Supporters of a proposed constitutional amendment that would ensure abortion rights in Florida continue moving closer to submitting enough petition signatures to get on the 2024 ballot.

The Florida Division of Elections website Friday showed 687,700 valid petition signatures for the measure, which is sponsored by the political committee Floridians Protecting Freedom.

Florida Attorney Ashley Moody To Fight Abortion Constitutional Amendment

She pointed to part of the proposed amendment that says it would prevent restrictions on abortion before “viability.” Moody wrote in the opinion piece that “viability” can have more than one meaning.

“While I personally would not vote for this initiative no matter what definition of ‘viability’ it was using, I know that to some voters, it is material to their vote — whether you are talking about an abortion in the first trimester or at the end of the second trimester,” the opinion piece said. “Floridians are entitled to know clearly and concisely what they are voting for or against.”

Florida Abortion Initiative Tops 400,000 Signatures


Supporters of a proposed constitutional amendment aimed at ensuring abortion rights have topped 400,000 valid petition signatures submitted to the state.

The total reflects signatures that have been validated, not necessarily the overall number of signatures collected. Floridians Protecting Freedom would need to submit at least 891,523 valid petition signatures to get on the 2024 ballot.

Also, it would need the Florida Supreme Court to approve the proposed ballot wording. The committee has submitted enough signatures to trigger a Supreme Court review, though it remains unclear when that review will take place.

Floridians for Protecting Freedom announced the ballot initiative in May after the Republican-controlled Legislature approved a bill that seeks to prevent abortions after six weeks of pregnancy.

The proposed amendment would bar laws that restrict abortion “before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider.”

Florida Supreme Court will decide the future of abortion access in the state


The Florida Supreme Court is pondering a law that could lead to abortions essentially being banned in Florida.

In September the state Supreme Court heard oral arguments in the case of Planned Parenthood of Southwest and Central Florida v. State of Florida. It challenges the state’s 2022 law banning abortion in Florida past 15 weeks of pregnancy.

Florida's post-Roe v. Wade abortion uptick


States near those that banned abortion after Roe v. Wade was overturned saw sharp increases in the number of procedures performed, likely due to an influx of out-of-state patients, according to a new analysis from the Guttmacher Institute.

Florida has long been a refuge for people living in southern states with abortion bans. The state saw a 13% increase in the procedure over the last three years, based on a comparison of 2020 and 2023 data for the first six months of each year.

We're likely picking up patients from Georgia, whose number of abortions went down 18% over the last three years. The state's six-week abortion ban went into effect last summer.
