This major tort package (HB 837) already passed the Florida House and will essentially cut access to the courts for everyday Floridians who are hurt due to negligence and are seeking justice via a civil lawsuit. It also impacts Floridians' ability to sue when an insurance company low-balls them or drags their feet on a claim.
For example, if someone is paralyzed in a criminal act on a property that has had repeated criminal activity, and steps have not been taken to make it safe, this bill would make it much harder for that person to receive compensation for their medical needs.
As noted by attorney Todd Michaels: "You are about to lose all of your leverage against your own insurance company — your health insurance, your life insurance. All of the leverage for them to do the right thing is taken away."
The Florida Senate will hear the bill on the floor this week.
